AER Review of the Exemptions Frameworks for Embedded Networks

The Australian Energy Regulator (AER) has proposed a review of the exemptions frameworks for embedded networks and released two documents for public comment: the Draft Network Exemptions Guideline (Version 7) and the Draft Retail Exempt Selling Guideline (Version 7).

The Marina Industries Association (MIA), in collaboration with its Silver Sponsor, Energy On, has assessed the potential impacts of the draft guidelines on marinas and submitted a formal response to the AER.

The MIA continues to assist the AER in understanding the diverse uses of marina berths, advocating for the frameworks to be applied in a proportionate and appropriate manner. This aims to ensure that marina berths used for non-residential recreational storage are not inadvertently captured under regulatory frameworks intended for other user types, which carry significant administrative burdens.

The MIA will keep its members informed of the outcomes of the review and any resulting amendments that may affect marina operations.

Given that most marinas sell electricity through embedded networks, compliance with the regulations is essential. The MIA encourages marina operators to engage with this issue, particularly in light of the AER’s recent enforcement actions and substantial penalties for non-compliance. While the legislation is highly technical and its application varies across different marinas, Energy On is available to assist operators in understanding their compliance obligations.
